An easy-to-use guide on Vietnam’s labour laws, particularly regarding trade unions and their establishment within companies, was released on Nov. 11 by leading human resources development firm Navigos Group.
The White Paper report is titled The Development of Trade Unions in Vietnam .
The report, based on current Vietnamese laws, presents actual practices by companies successfully running their own trade unions. It also provides comprehensive information and guidelines for establishing trade unions, and addresses critical issues such as trade union funds and the role of trade union negotiations in avoiding strikes.
The failure to follow these regulations has been blamed in many instances of wildcat strikes that have broken out at many foreign-invested enterprises over the last decade.
The report is geared towards foreign companies either planning to enter Vietnam or already doing business here. The report adopts an easy-to-understand format to present information on the complicated articles on labour codes, trade union laws and its subordinate regulations. It also includes a step-by-step guide on compliance with the current labour laws.
Winnie Lam, director of the group’s Human Resource Advisory Services, said: “Given that Vietnamese law is still under development and there are various interpretations for a certain regulation while it requires various approaches to the issue in practice, Navigos has developed this report to equip companies with the best understanding of the law and how to apply it in practice. Its focus on practical experience is truly valuable information to any company planning to set up trade unions in their own companies”.
He added the report would be updated from time to time with new information relating to trade union laws.
