Urban Development Law introduces additional mechanisms and policies for education and high-quality human resource development

The Urban Development Law's provisions on education and training development set out mechanisms, policies, and the city's authority in the management and development of education. The provisions focus on financial mechanisms, the mobilization of socialized resources, scholarship policies, incentives for talented individuals, support for learners and educational staff, and the training and fostering of high-quality human resources. They also stipulate the authority of the City People's Committee over educational partnerships, quality, and curricula.

Under Article 27 on education and training development, the city is permitted to formulate and implement various mechanisms and policies to develop different types of educational institutions, improve the quality of education, support learners, teachers, and educational managers, and develop high-quality human resources.

Specifically, the City People's Council is authorized to stipulate management and financial mechanisms, the use of public assets, and the mobilization of socialized resources for multi-level educational institutions, high-quality educational institutions, institutions implementing educational partnerships, and advanced and modern school models.

The regulation provides a basis for the city to proactively formulate appropriate mechanisms for different types of educational institutions in line with the city's educational development requirements.

The City People's Council is also authorized to stipulate scholarship policies and special incentive mechanisms for individuals with aptitude, talent, and exceptionally outstanding achievements. The city may formulate mechanisms and policies to encourage and support learners, teachers, educational managers, and heads of educational institutions in studying, conducting research, and serving as guest lecturers in Vietnam and abroad in key fields and sectors as stipulated by the City People's Committee.

Notably, the regulation also authorizes the City People's Council to decide on mechanisms and policies to support education and promote comprehensive educational development at educational institutions across the city.

This group of policies covers all aspects, from support for learners, teachers, and managers to support for educational development at educational institutions, thereby providing a legal basis for the city to specify details within its assigned authority.

Another provision concerns mechanisms for developing high-quality human resources. Accordingly, the City People's Council is authorized to stipulate mechanisms and policies for assigning tasks, placing orders, or organizing bidding for the provision of training and fostering services by higher education institutions, vocational education institutions, research institutes, and domestic and foreign organizations with training and fostering functions to develop high-quality human resources.

In addition, the city has policies to support local businesses, organizations and individuals in participating in educational activities.

The policies stipulated in Article 27 cover a broad range of participants in educational activities, including educational institutions, learners, teachers, managers, businesses, organizations, and individuals.

In addition to the authority vested in the City People's Council, Article 27 specifically stipulates several powers of the City People's Committee in the field of education. Accordingly, the City People's Committee regulates educational partnerships between public and non-public preschools, general education institutions and foreign educational institutions.

The City People's Committee also stipulates criteria and conditions for ensuring the quality of education and educational services at educational institutions in the group specified in Point a, Clause 1, Article 27, as well as at the city's key educational institutions.

Regarding educational curricula, the City People's Committee is authorized to supplement preschool and general education curricula. However, such supplementation must ensure educational goals and the qualities and competencies required of students, as well as the mandatory content of the national preschool and general education curricula.

At the same time, the regulation sets clear requirements for the city's curriculum supplementation. The supplemented content must meet the requirements of the national curriculum, including educational goals, the qualities and competencies to be achieved, and mandatory content.

In addition to supplementing curricula, the City People's Committee is authorized to issue preschool and general education curricula for educational institutions in the group specified in Point a, Clause 1, Article 27. These curricula must be consistent with the city's educational development goals and the requirements of the national education curriculum.

The separate stipulation of the City People's Committee's authority over these matters provides a clear delineation of responsibilities in implementing educational policies while also clearly defining the requirements that the city's educational programs must meet.

Article 27 also stipulates the authority of the Chairperson of the City People's Committee in accordance with the regulations of the City People's Committee.

Accordingly, the Chairperson of the City People's Committee decides on the establishment, merger, division, separation, dissolution, renaming, and licensing of operations of public universities and colleges managed by the city and permits the establishment, merger, division, separation, dissolution, renaming, and licensing of operations of private universities and colleges in the city.

A notable point of the Urban Development Law is that, in addition to granting the city the authority to stipulate and organize the implementation of certain matters, the law sets specific requirements to ensure the quality and consistency of educational activities. In particular, regarding the supplementation and issuance of preschool and general education curricula, the city's programs must be consistent with the city's educational development goals and the requirements of the national education curriculum; curriculum supplementation must ensure educational goals and the qualities and competencies students need to achieve, as well as mandatory content.

For universities and colleges with foreign investment or institutions engaged in training partnerships with foreign educational institutions in the city, the Chairperson of the City People's Committee is authorized to permit their establishment, merger, division, separation, dissolution, renaming, and licensing after receiving opinions from the Ministry of Education and Training.

Article 27 not only focuses on policies to support and develop education but also specifically stipulates the authority of each level in the management, organization and development of educational institutions. Covering management and financial mechanisms, the use of public assets and the mobilization of socialized resources; scholarship and incentive policies for individuals with aptitude, talent and exceptionally outstanding achievements; policies to support learners, teachers and educational managers; and mechanisms for training and fostering high-quality human resources, the provisions of Article 27 establish a relatively comprehensive policy framework for the city's education and training sector.

Through this regulatory approach, Article 27 establishes specific groups of powers and policies for the city in developing education and training, while clearly defining the scope and conditions applicable to each area. This framework provides the basis for the City People's Council, the People's Committee, and the Chairperson of the City People's Committee to carry out their assigned tasks and exercise their powers, contributing to the implementation of educational policies in line with the city's development requirements.
