The currently applied Import – Export Law allows the Government to impose additional duties on import products that have selling prices that are abnormally lower than the average price levels of the same kinds, which could cause difficulties to local producers.

 

The safeguard measures are also mentioned in the ordinance on safeguard measures ratified by the National Assembly’s standing committee on May 25, 2002 and ordinance No 22 on measures against the subsidisation of imports to Vietnam dated August 20, 2004.

 

Minister of Trade Truong Dinh Tuyen said that one of the most important tasks now is to build up a completed legal framework with detailed regulations on taking safeguard measures against imports to Vietnam. The documents must come in line with the situation in Vietnam, Vietnam’s laws and with WTO agreements.

 

He stressed that it is the responsibility of the Ministry of Trade to discover, investigate and tackle dumping cases in Vietnam.

 

However, the minister has acknowledged that the Government now is still not ready to investigate dumping cases due to the incapability of staff. Mr Tuyen said that the readiness of staff will be improved in the near future, after they are further trained.

 

In addition, the Competition Administration Department under the Ministry of Industry has been established, and will play a very important role in cases related to dumping activities in the future.

 

Ton Nu Thi Ninh, Deputy Chairman of the National Assembly’s Foreign Affairs Committee, has also urged the Government to launch a big programme to train staff and lawyers who will play an active role in the national economy in the WTO period.
