Draft law offers more supports for Vietnamese guest workers

This is provided in draft amendments to the Law on Vietnamese Guest Workers prepared by the Ministry of Labor, Invalids and Social Affairs (MOLISA).

As per the draft, the State would promote international cooperation to expand new overseas labor markets, thus helping Vietnamese guest workers have high-paid jobs and improve their professional skills.

Annually, the MOLISA would notify provincial-level People’s Committees of guest workers who are going to return to their localities for the latter to prepare necessary conditions to help these workers integrate themselves into the local community.

Provincial-level People’s Committees would, based on local socio-economic conditions and budget capacity, formulate support policies for guest workers for reporting to People’s Councils of the same level for decision.

Meanwhile, enterprises and non-business organizations providing the service of sending workers abroad would be required to post on their websites information on local job transaction floors and employment-related websites.

Noteworthily, the draft revises provisions on the charge for the service of sending workers abroad. Accordingly, expenses for sending workers abroad would be shared between workers and foreign employers to heighten businesses’ responsibilities and reduce expenses for guest workers.

Specifically, a Vietnamese guest worker would have to pay the labor export company that sends him abroad an amount equal to the service charge rate registered by the labor export companies with competent agencies. The payment would be made only after the worker officially signs a guest worker contract with the labor export company. However, if the worker’s foreign employer has paid an amount of service charge to the company, the worker would only pay the company an amount equal to the ceiling service charge rate minus the amount paid by the foreign employer. The ceiling service charge rate for each overseas labor market would be prescribed by the Minister of Labor, Invalids and Social Affairs after reaching agreement with the Minister of Finance.

The draft also specifies conditions on labor export companies providing guest worker services, including a charter capital of at least VND 5 billion (USD 216,200), professionally experienced personnel, and suitable physical foundations.
