Passengers to enjoy higher compensation for airline service failures

Air carriers would be required to pay a compensation of up to VND 4.1 billion (USD 173,000)  to victims of plane accidents, according to a draft decree compiled by the Ministry of Transport (MOT).

 Those whose flights are delayed or cancelled would receive roughly VND 170 million (USD 7,300).

Passengers may also enjoy a compensation of up to VND 40 million (USD 1,730) if their baggage, including carry-on baggage and checked baggage, are lost or damaged or late delivered.  

As explained by the MOT, the 1999 Montreal Convention for the Unification of Certain Rules for International Carriage became effective in Vietnam from November 26, 2018.  In June 2019, the International Civil Aviation Organization (ICAO) proposed raising the level of compensation for damage caused to passengers, luggage and goods due to airline service failures. The draft decree is formulated in conformity with the ICAO’s proposal. 

The MOT would soon finalize the draft and submit to the Government so as to apply the new regulations from December 28, 2019, the tentative effective date of the ICAO’s proposal. The above-said compensation level would be applied to all passengers on domestic and international flights.
