The Vietnamese government has recently issued Decree No. 114/2016/NĐ-CP stipulating the fees for adoption registration and granting operational license to foreign adoption organizations.
 
 

The Vietnamese government has recently issued Decree No. 114/2016/NĐ-CP stipulating the fees for adoption registration and granting operational license to foreign adoption organizations.

The decree specifies the payers and collectors of the adoption registration fee; its rate and its exemption and reduction, management and use; and expenses for settling intercountry adoptions as well as granting operational licenses to foreign adoption agencies in Vietnam.  

Accordingly, the rate charged for domestic adoption registration is VND400,000 (US$18) per case, while it will be VND9 million (US$405) per case if adoption registrants are Vietnamese citizens temporarily residing abroad.

The registration fee will be VND4.5 million (US$202.5) per case for foreigners who are permanently residing in Vietnam and seeking to adopt a Vietnamese child.

The same rate has to be paid by foreigners who are residing in border areas of neighbouring countries and seeking to adopt a Vietnamese child permanently residing in Vietnam’s border areas.

The expense for adoption registration at overseas-based Vietnamese representative missions is US$150 per case. The rate will be converted into the host country’s currency according to the selling rate of the US dollar published by the bank where the Vietnamese representative mission in that country opens its account.

A foreign adoption organization will have to pay VND65 million (US$2,925) to receive a license to operate in Vietnam and another VND35 million (US$1,575) to renew that license.

Fee collecting agencies

The decree specifies the competence to collect the adoption registration fee. Accordingly, the communal People’s Committees collect the domestic adoption registration fee and the registration expense charged for foreigners who are residing in border areas of neighboring countries and seeking to adopt a Vietnamese child permanently residing in Vietnam’s border areas.

The Ministry of Justice is authorized to collect the adoption registration fee charged for foreigners permanently residing in Vietnam and seeking to adopt Vietnamese children.

The Department of Adoption under the Justice Ministry collects the intercountry adoption registration fee, excluding the mentioned above case, and renews the operational licenses of foreign adoption organizations.

The overseas-based Vietnamese representative missions collect the fees for adoption registrations conducted at the missions.
