Foreign organizations and individuals that commit acts of violation in the planning and investment domain specified face penalties ranging from caution to monetary fines of up to VND 70 million.
Decree No. 53/ND-CP, issued by the Government on April 4, provides in detail sanctioning forms and levels applicable to persons committing acts of violating regulations on socio-economic development planning, state budget-funded investment, business registration of enterprises, cooperatives and business households; improperly using state capital in elaboration of feasibility study reports or investment reports, organizing bidding for selection of contractors, signing of contracts, and supervision of quality of construction projects.
Apart from being fined, violating organizations or individuals can also be banned from participating in bidding activities for between six months to one year.
State officials and employees who commit acts of violation in the planning and investment domain while on duty will not be administratively sanctioned but will be disciplined according to the provisions of law on public employees. Laborers working under labor contracts in state agencies or organizations who commit acts of violation while on duty will be examined for liability under their labor contracts.
