Decree No. 107/2006/ND-CP: Responsibilities of heads of agencies for corruption

This Decree, issued by the Government on September 22, provides for the responsibilities of heads and deputy heads of agencies, organizations and units in state agencies, political organizations, socio-political organizations, peoples armed force units, non-business units and state enterprises as well as other agencies, organizations and units that use state budget and property, where corruption occurs.

Such heads and deputy heads may be subject to reprimand, caution or dismissal, or examined for penal liability if showing signs of a crime.

 

They may be exempt from responsibilities in cases in which they cannot know, or have applied necessary measures to prevent, corrupt acts.

 

If they have submitted applications for resignation which have been accepted by competent authorities; applied necessary measures to prevent, or overcome consequences of, corrupt acts; or strictly handled, or promptly reported, corrupt acts to competent authorities, they shall be subject to lesser discipline.

 

Those who fail to apply measures to preclude, or overcome consequences of, corrupt acts; or have detected corrupt acts but fail to strictly handle them or promptly report them to competent authorities shall be subject to severer discipline.
