Under this Decree, issued on August 24 by the Government, multi-level sale of goods means an approach of marketing to retail goods which meets the conditions specified in Clause 11, Article 3 of the Competition Law.
Individuals having full civil act capacity, good judicial backgrounds and working permits, for foreigners and overseas Vietnamese, are entitled to enter into contracts with multi-level sale enterprises for participating in multi-level sale of all goods, except for goods on the list of goods banned from circulation or the list of goods subject to restricted business, fake goods and illegally imported goods; and goods being preventive and curative medicines for human use, vaccines and immuno-biologicals; medical equipment and instruments, assorted veterinary drugs, plant protection drugs, insecticidal and germicidal chemicals and preparations for domestic and medical use, raw materials for manufacture of curative medicines, toxic chemicals and products containing toxic chemicals specified by law.
Goods traded by multi-level sale mode must be up to the food quality, safety and hygiene standards provided for by law, have clear and lawful origins, utilities and labels.
Multi-level sale enterprises can conduct multi-level sale after applying for and obtaining multi-level sale organization registration papers, which would be granted within 15 days after receipt of applications by provincial-level Trade Services or Trade-Tourism Services where enterprises have made their business registrations.
