Decree No.95/2005/ND-CP

This Decree, issued by the Government on July 15, applies to domestic organizations and individuals; overseas Vietnamese; and foreign organizations and individuals that have dwelling houses or construction works lawfully built in Vietnam.

This Decree, issued by the Government on July 15, applies to domestic organizations and individuals; overseas Vietnamese; and foreign organizations and individuals that have dwelling houses or construction works lawfully built in Vietnam .

Provincial-level People’s Committees shall grant or authorize provincial/municipal Construction Services to grant dwelling house ownership and construction work ownership certificates to domestic and foreign organizations.

District-level People’s Committees shall grant dwelling house ownership and construction work ownership certificates to domestic and foreign individuals as well as overseas Vietnamese.

Under the Decree, the said ownership certificates shall not be granted to:

- Makeshift houses; dwelling houses and construction works under the ownership of all the people, except for works assigned as capital by the State to enterprises;

- Dwelling houses and construction works subject to relocation, dismantlement or land recovery decisions of competent State agencies;

- Dwelling houses and construction works located in areas where construction is banned or encroaching upon landmarks for the protection of infrastructural works, historical or cultural relics which have already been graded; and

- Dwelling houses and construction works subject to commitments between the Vietnamese Government and foreign governments or international organizations.
