Researching on management, operation and toll collection methods for 3 expressways

On August 11, according to the Dong Nai Provincial People's Committee, the Ministry of Construction issued Official Document No. 8105/BXD-KHTC to the Vietnam Road Administration and the People's Committees of provinces and centrally run cities regarding the study and proposal of toll collection mechanisms for expressway construction projects co-funded by the central and local budgets.

Currently, Dong Nai province has three expressways invested by joint central and local budgets: Bien Hoa - Vung Tau, Ho Chi Minh City - Chon Thanh, and Ring Road 3 - Ho Chi Minh City.

According to the Ministry of Construction, following the provisions of Clause 3, Article 50 and Clause 1, Article 84 of the Road Law, the Ministry of Transport, now the Ministry of Construction, has drafted and submitted to the Government Decree No. 130/2024/ND-CP dated October 10, 2024, regulating toll collection on expressways owned by the entire people, with the government as the owner's representative directly managing and operating them.

For expressway projects assigned by the National Assembly and Government to localities for investment via joint funding between central and local budgets, the government directed: "The Government directs the Ministry of Transport to take the lead and coordinate with the Ministry of Finance, relevant ministries, and localities to develop a plan to recover the project investment capital and reimburse the central and local budgets according to their investment contribution ratios".

During the drafting of the decree regulating toll collection on expressways owned by the people and directly managed by the Government, the Ministry of Construction studied methods to allocate revenue shares to reimburse central and local budgets according to project investment ratios.

However, as this method is not yet consistent with current regulations on fees, it has not been stipulated in Decree No. 130. Therefore, the plan to reimburse investment capital based on the proportion of capital contributed to the project needs to be further studied and proposed in the Scheme on the Exploitation of Road Traffic Infrastructure Assets, in accordance with Government Decree No. 44/2024/ND-CP dated April 24, 2024, on the management, use, and exploitation of road traffic infrastructure assets.

Accordingly, the Ministry of Construction assigned the Vietnam Road Administration to work proactively with local authorities to review project implementation progress and agree on plans for the management, operation, and toll collection of expressway construction projects for which the State is the representative owner and directly manages and operates. It also involves determining the allocation of toll revenues between the central and local budgets for projects co-financed by both, reporting to the Prime Minister, and completing legal regulations as directed by the National Assembly.
