From March 1, based on the nature and seriousness of violations of counterfeit goods production and trading, applicable administrative fines will be between VND 100,000 and 100,000,000.
Under Government Decree No. 08/2013/ND-CP of January 10, on the sanctioning of counterfeit goods production and trading, counterfeit goods include goods of no utility, goods bearing imitate marks or in counterfeit packages which illegally assume names and addresses of other traders, goods specified in Article 213 of the 2005 Intellectual Property Law, and counterfeit stamps, labels and packages.
From March 1, administrative fines will be doubled but not exceed the maximum fine level mentioned above for counterfeit goods which are foods, medicines, animal feeds, fertilizers, veterinary drugs, pesticide, plant varieties, animal breeds, food additives, cosmetics, medical equipment, cement, building steels, crash helmets, or counterfeit stamps, labels and packages of these products.
The new regulation also specifies forms of additional sanctions and remedial measures for specific cases of counterfeit goods production or trading. For example, for the act of trading goods of no utility, administrative fines will range from VND 500,000 to 50,000,000 depending on the value of the equivalent quantity of authentic goods. Remedial measures include destruction of counterfeit goods, compelled re-export from Vietnam or remittance of all profits earned from the trading of these counterfeit goods to the state budget.-
